生日歌版權終於定案，美國法院裁定，《生日快樂》歌屬於無任何保護的「公共領域」(public domain)，意味任何人及商家播放《生日快樂》這首歌時，都無需再支付版權費用。

美聯社報導，這宗歷時兩年案件，起因「Good Morning to You製作公司」2013年向華納提出訴訟，稱此歌是屬公共財產，不受知識產權保護，並要求華納歸還逾500萬美(約1.63億元台幣)版權費給曾付款的人士或組織。

《生日快樂》歌原本是1893年由希爾(Mildred J. Hill及Patty Smith Hill)姐妹創作的早安歌，隨後演變成「Happy birthday to you」，華納音樂集團自1988年買下這首生日歌的版權。

法官認為，「生日快樂的歌詞出處已不大清楚」，同時強調：「希爾姐妹只向Summy公司給予歌曲旋律的版權，以及根據旋律而作的鋼琴編曲，並不包括歌詞的版權」，因此判華納音樂沒擁有版權。

The birthday song copyright finally finalized, the court ruled that the “Happy birthday song” belongs to “public domain without any protection” (public domain), means any person and businesses to play “Happy birthday” this song, no need to pay copyright fees.

The Associated Press reported that this case lasted two cases, “Good Morning to causes You production company” in 2013 to sue Warner said, this song is a public property, not subject to the protection of intellectual property rights, and Warner returned more than $5 million (about 163 million yuan NT) copyright fee to have payment or organization.

“Happy birthday song” was originally in 1893 by Hill (Mildred J. Hill Patty and Smith Hill) sisters creation morning song, then evolved into “Happy birthday to” you, Warner Music Group since 1988 to buy the birthday song copyright.

Judge, “Happy birthday lyrics source has not clear”, also stressed: “the Hill sisters only to the Summy company to give the song melody of the copyright, and according to the melody and the piano arrangement, not including the lyrics of copyright”, therefore sentenced Warner Music did not have copyright.
